Kelvin Chia Partnership (“KC Partnership”) takes the protection of your personal data seriously.

KC Partnership is a regional law firm headquartered in Singapore and has offices located in other key Asian cities, such as Bangkok, Hanoi, Ho Chi Minh City, Jakarta, Mandalay, Phnom Penh, Shanghai and Yangon. References to “KC Partnership”, “we”, “us”, “our” in this Privacy Policy means KC Partnership, its affiliated firms and other entities carrying on business under or including the name Kelvin Chia.

This Privacy Policy sets out the manner in which KC Partnership collect, use, manage and protect personal data in compliance with the provisions of Singapore’s Personal Data Protection Act 2012 (“PDPA”). In this Privacy Policy, “Personal Data” refers to any data, whether true or not, about an individual who can be identified (a) from that data; or (b) from that data or other information that we have or are likely to have access. This excludes “business contact information” as defined under the PDPA. If you are under 18, please do not provide us with any of your information unless you have the permission of your parent or guardian to do so.

We reserve the right to amend this Privacy Policy at any time and for any reason. This version was last updated on 09 November 2019. By continuing your relationship with us after any such amendments to this Privacy Policy, you are deemed to have accepted our amended Privacy Policy.

1. How We Collect Personal Data

We may collect your Personal Data in various ways including:

a) when you enquire about or engage our legal services by any means;
b) when you visit our premises;
c) when you subscribe to our publication(s), alerts and/or announcements;
d) when you attend our events and seminars;
e) when you submit your Personal Data for and pursuant to an employment application;
f) when you communicate with us via email, phone, livechat, this Website or by post;
g) when you submit your Personal Data to us any other reason; and
h) when your information is publicly available.

2. Personal Data Collected

We will only collect, use or disclose Personal Data which we reasonably deem to be necessary for the purposes underlying such collection, usage or disclosure. The Personal Data we collect may include (but is not limited to):

a) your name, title, date of birth, gender, marital status, passport number, identification number, photograph, visa or permit number;
b) your contact particulars including mailing and email address and phone number;
c) your employment history and academic qualifications;
d) the name and contact details of your next-of-kin;
e) your payment details, including your bank account, payment card details and billing addresses;
f) information about your use of our website that are collected when you access our website, including your IP address, browser type and version, your log in data, time zone setting and location, operating system, platform, and other technology on the devices you are using; and
g) any other information you may provide, whether directly or via your legal representatives, about an individual who can be identified from that data.

In providing us with a third party’s Personal Data, you represent to us that you have obtained the third party’s consent for the collection, use or disclosure of his/her Personal Data in accordance with this Privacy Policy.

3. Purpose of Collection, Usage and Disclosure

We collect, use, and/or disclose Personal Data for one or more of the following purposes:

a) providing our services;
b) responding to your queries and suggestions;
c) verifying your identity and processing payments;
d) providing you with seminar and marketing updates and advertising which you have subscribed to—you may opt out of our mailing list within the marketing/promotional materials we send to you. Once you have opted out, we will no longer send to you marketing/promotional materials;
e) recording and/or taking photographs of participants at our events and seminars;
f) processing and managing your employment application; and
g) complying with applicable laws and regulations.

We will only use your Personal Data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact our Data Protection Officer.

If we need to use your Personal Data for an unrelated purpose, we will notify you and we will explain the basis which allows us to do so. We will obtain your full and informed consent before using your Personal Data for an unrelated purpose.

Please note that we may process your Personal Data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

4. Disclosure and Transfer of Personal Data

We may disclose your Personal Data to the following parties:

a) our affiliated firms and other third party foreign law firms which are assisting with your matter(s);
b) agents, contractors or third party service providers who provide information technology and system administration services to us;
c) our professional advisers or consultants, including lawyers, bankers, auditors, accountants and insurers providing consultancy, legal, banking, audit, accounting or insurance services to us;
d) any relevant authorities including law enforcement agencies, government authorities, regulatory agencies, statutory boards, government officials or legal process participants whether local or overseas;
e) the extent necessary to comply with any laws and regulations;
f) any person to whom disclosure is permitted and required by law; and
g) any other party to whom you have authorised or consented to having your data disclosed.

Depending on the services which you may require, the collection, use and disclosure of your Personal Data may not limited to the country in which you are based. Where you engage us to perform work outside Singapore, you consent to us transmitting your Personal Data to other jurisdictions as may be necessary to give effect to your instructions. Your Personal Data may be transferred to, processed and accessed in countries whose laws provide a different level of protection, which may not necessarily be comparable to that provided in Singapore. We will nonetheless take all reasonable steps to ensure the security and integrity of your Personal Data in accordance with the PDPA.

By accessing and using the website, you acknowledge and agree that we may store, process and use any Personal Data collected in the course of using and accessing the website, and provide such Personal Data to employees, agents, contractors and other third parties, which may or may not be located outside of your resident jurisdiction. By providing us with your Personal Data, you specifically consent to such transfers of your Personal Data to a country or jurisdiction other than that where it was collected only for the purposes described in this Privacy Policy. 

As stated above, in the course of processing your Personal Data, it may be necessary to disclose and/or transfer Personal Data or any part thereof within KC Partnership, third party service providers and/or other relevant third parties throughout the world for the stated purposes set out in this Privacy Policy. Any disclosure or transfer will be made in accordance with applicable laws.  As a general practice, KC Partnership will not sell, rent, or give physical possession of Personal Data to any third parties for any other purposes, apart from those stated in this Privacy Policy.

5. Consent and Withdrawal of Consent

We will not collect, use or disclose your Personal Data without your consent unless authorised under the PDPA or any other applicable law.

You may withdraw your consent to any use or disclosure of your Personal Data by us at any time by contacting our Data Protection Officer. Depending on the nature and extent of your withdrawal of consent, we may not be in a position to continue providing our services to you.

6. Protection of Personal Data

We have put in place appropriate security measures to prevent your Personal Data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. Your Personal Data will be protected using encryption. In addition, we limit access to your Personal Data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data based on this Privacy Policy, based on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

7. Access and Correction

Please contact our Data Protection Officer if you:

• would like to access your Personal Data held by us;
• would like to obtain information about the ways in which your Personal Data in our possession has been or may have been used or disclosed by us in the year preceding the request; or
• would like to make corrections to your Personal Data held by us.
• would like to request erasure of your Personal Data.

Please note that under the PDPA, there are certain situations where we will not be required to provide access and correction to Personal Data. We reserve the right to charge a reasonable fee for the processing of any such access requests.

It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes and when it is no longer accurate during your relationship with us. 

8. Retention

We will only retain your Personal Data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any commercial, legal, regulatory, tax, accounting or reporting requirements. We may retain your Personal Data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for Personal Data, we consider the amount, nature and sensitivity of the Personal Data, the potential risk of harm from unauthorised use or disclosure of your Personal Data, the purposes for which we process your Personal Data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

In some circumstances you can ask us to delete your data: see Paragraph 5 of the Privacy Policy for further information.

In some circumstances we will anonymise your Personal Data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

9. Use of Cookies

A cookie is a small file which is placed on your device when you access this Website to enhance user experience. These cookies do not gather any Personal Data and you may disable the use of cookies at any time via the settings in your browser. This may however prevent you from taking full advantage of this Website.
